1. General Provisions

This privacy policy of the Online Store is informative, which means that it is not a source of obligations for Service Recipients or Customers of the Online Store. The privacy policy contains rules regarding the processing of personal data by the Administrator in the Online Store, including the grounds, purposes and period of personal data processing and the rights of data subjects, as well as information on the use of cookies and analytical tools in the Online Store.
The administrator of personal data provided by the website user is Agora-Owietlenie, with its registered office in Częstochowa at Wręczycka 152/154, NIP: 5731681804, Regon: 150255465. Contact with the personal data administrator is possible via e-mail: lamp@agora-oswietlenie. pl.
Personal data collected by the Online Store Administrator are processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27/04/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95 / 46 / EC (general regulation on data protection) (Official Journal of the EU L 119, p. 1), hereinafter referred to as: GDPR.
The Administrator of the Online Store makes special efforts to protect the privacy and information provided to him regarding the Customers of the Online Store. The administrator selects and applies appropriate technical measures, including those of a programming and organizational nature, to ensure the protection of the processed data with due diligence, in particular, protects the data against unauthorized disclosure, disclosure, loss and destruction, unauthorized modification, as well as against their processing in violation of applicable law.
Taking into account the nature, scope, context and purposes of processing as well as the risk of violating the rights or freedoms of natural persons with varying likelihood and severity, the Administrator implements appropriate technical and organizational measures to ensure that the processing is carried out in accordance with this regulation and to be able to demonstrate it. These measures are reviewed and updated as necessary. The administrator uses technical measures to prevent unauthorized persons from obtaining and modifying personal data sent electronically.

2. Purposes and legal grounds for processing personal data

The personal data administrator processes your personal data for the following purposes and scope:

take action before concluding the contract at your request (e.g. setting up an account), i.e. data provided in the registration form in the Online Store, i.e. e-mail address and password, gender; if the Account registration is done via an external authentication service (e.g. Google+, Facebook), we collect your name and surname, and if you register when purchasing Goods, we collect your name and surname and data provided in order to complete the order, such as the shipping address; in order to provide Services that require setting up an Account, such as: keeping order history, informing about the status of order fulfillment, we process your data provided in the Account and when purchasing Goods;

in order to provide Services that do not require the creation of an Account and the purchase of Goods, i.e. browsing the websites of the Online Store, search engine for Goods, we process personal data regarding your activity in the Online Store, i.e. data on the Goods you browse, data on the session of your device, operating system , browser, location and unique ID, IP address;

in order to perform the contract for the sale of Goods (e.g. delivery of ordered Goods), we process personal data provided by you when purchasing Goods, such as name and surname, e-mail address, address details, payment details, and if you make a purchase via an Account , additionally set password;

for statistics on the use of individual functionalities available in the Online Store, facilitating the use of the Online Store and ensuring the IT security of the Online Store, we process personal data regarding your activity in the Online Store and the amount of time spent on each of the subpages in the Online Store, your search history, location, IP address, device ID, data about your web browser and operating system;

in order to establish, pursue and enforce claims and defend against claims in court proceedings and other enforcement authorities, we may process your personal data provided when purchasing Goods or setting up an Account and other data necessary to prove the existence of a claim or which result from a legal requirement, court order or other legal process;

in order to consider complaints, complaints and requests and to answer customer questions, we process the personal data provided by you in the contact form, complaints, complaints and requests, or in order to answer questions contained in a different form and some personal data provided by you in the Account as well as data regarding the order of the Goods and other Services provided by us, which are the cause of the complaint, complaint or request, as well as data contained in the documents attached to the complaint, complaint and request;

for the purpose of marketing our Goods and Services as well as our clients and partners, including remarketing, for this purpose we process personal data provided by you when creating an Account and updating it, data regarding your activity in the Online Store, including orders, which are registered and stored via cookies, in particular order history, search history, clicks in the Online Store, login and registration dates, history and your activity related to our communication with you. In the case of remarketing, we use data about your activity to reach you with our marketing messages outside the Online Store and we use the services of external providers for this purpose. in order to organize competitions and loyalty programs, i.e. notifications about accumulated points, notifications about winning and advertising our offer, we use your personal data provided in the Account and when registering in a competition or loyalty program. Detailed information on this subject is provided each time in the terms of participation of a given contest or loyalty program;

for the purpose of market and opinion research by us or our partners, i.e. information about the order, your data provided in the Account or when purchasing the Goods, e-mail address. Data collected as part of market research and opinion polls are not used by us for advertising purposes. Detailed instructions are given in the information about the given survey or in the place where you enter your data.

3. Recipients of personal data in the online store

We transfer your personal data to the following categories of recipients:

service providers that we use when running the Online Store, e.g. in order to fulfill the order, among others:

carriers / freight forwarders
entities handling electronic payments or by payment card
providers of technical, IT and marketing solutions enabling business activity, including the Online Store and electronic services provided through it

4. Rights of data subjects

User rights in relation to the administrator regarding the processing of personal data:

· Access to personal data, rectification, limitation of processing, transfer and deletion

The user has the right at any time to free access to personal data concerning him, to information about the source of this data, their recipients and the purposes of their processing via the agora-oswietlenie.pl website. The user has the right to request the administrator to immediately rectify, delete, transfer and limit the processing of personal data concerning the user, provided that there are legal grounds for doing so.

· Right to withdraw consent

You can withdraw your consent to the processing of your personal data at any time. Withdrawal of consent to the processing of personal data does not affect the lawfulness of the processing carried out on the basis of your consent before its withdrawal.

· Right to object

The user has the right to object at any time - for reasons related to a particular situation - to the processing of personal data concerning the user, i.e. to processing based on art. 6 sec. 1 lit. e or f GDPR, including profiling based on these provisions.

The administrator is obliged to stop processing personal data, unless he demonstrates the existence of valid legally justified grounds for processing, overriding the user's interests, rights and freedoms, or grounds for establishing, investigating or defending claims.

If personal data is processed for the purposes of direct marketing, the data subject has the right to object at any time to the processing of personal data concerning him or her for the purposes of such marketing, including profiling to the extent that the processing is related to such direct marketing .

· The right to lodge a complaint with the supervisory authority

the person whose data is processed by the Administrator has the right to lodge a complaint with the supervisory authority in the manner and manner specified in the provisions of the GDPR Regulation and Polish law, in particular the Act on the Protection of Personal Data. The supervisory authority in Poland is the President of the Office for Personal Data Protection.

The supervisory authority to which the complaint has been lodged informs the complainant about the progress and effects of the complaint, including the possibility of using a judicial remedy under Art. 78 GDPR.

5. Cookies in the online store

In order for the Website to function properly, the Service Provider uses cookie technology. Cookies are packets of information saved on the User's device via the Website, usually containing information consistent with the purpose of a given file, by means of which the User uses the Website. Cookies usually containing the website address, date of placement, expiration date, unique number and additional information in accordance with the purpose of the file. The Service Provider uses two types of cookies: session cookies, which are permanently deleted at the end of the User's browser session, and persistent cookies, which remain after the end of the browser session on the User's device until they are deleted. Based on cookies, both session and persistent, it is not possible to determine the identity of the User. The Cookies mechanism does not allow you to download any personal data. The Service Provider's cookies are safe for the User's device, in particular they do not allow viruses or other software to get into the device. External Cookies (i.e. Cookies placed by the Service Provider's partners) can be read by an external server. The User may disable the saving of Cookies on his device, in accordance with the browser manufacturer's instructions, but this may result in unavailability of some or all of the Website's functions. The Service Provider uses its own Cookies for the following purposes: authentication of the User on the Website and maintaining the User's session; configuration of the Website and adjusting the content of the pages to the User's preferences, such as: recognising the User's device, remembering the settings selected by the User; ensuring the security of data and the use of the Website; analyses and audience research; providing advertising services. The Service Provider uses External Cookies for the following purposes of creating (anonymous) statistics that allow optimising the usability of the Website, through analytical tools, including Google Analytics. The user can independently change the settings for Cookies at any time, specifying the conditions of their storage, through the settings of the web browser or through the configuration of the service. The user may also independently delete cookies stored on his device at any time, in accordance with the instructions of the browser manufacturer.
